Terms of Use

These Terms of Use (“Terms”) are the agreement between you and ThinkTorch AI LLC (“ThinkTorch,” “we,” “us”) for use of https://thinktorchai.com and the invite-only teacher beta.

If you do not agree, do not use the service.

Access is invite-only. We provision teacher accounts. There is no public self-service signup.

The service is intended for authorized teachers and education professionals in the United States. It is not a student product and does not provide student accounts.

ThinkTorch is designed for educational writing feedback. It is not designed for healthcare, counseling, medical-record storage or management, mandated reporting, or student-information-system functions.

The live production-ready teacher product in this beta is Writing Feedback Assistant. Other tools visible on the site may be previews or unfinished. Do not treat them as production services unless we say they are.

The beta may change, pause, or be withdrawn. Features can break. We do not promise uninterrupted availability.

You must use the email address we provisioned for you. Keep sign-in codes and access under your control. You are responsible for activity on your account, except where you have told us of unauthorized access and we have had a reasonable chance to act.

If your access should end (for example, you leave the school or the invitation is withdrawn), stop using the service and tell us.

You agree to use ThinkTorch lawfully and in line with your school or district policies.

You may not:

• try to break, probe, overload, or attack the service
• bypass authentication, usage controls, or other access controls
• access another teacher’s account or data
• use unauthorized scraping or systematically extract protected product content
• reverse engineer the service where prohibited by law
• use the service to harm students, harass others, or violate the law
• resell or publicly rehost the service

These limits do not prohibit ordinary observation, learning, teaching, or lawful use of outputs you receive as an invited teacher.

We may suspend or end access if these Terms are violated, if the invitation ends, or if we need to protect the service or other users.

You are responsible for what you enter, including assignment directions, rubric text, teacher notes, and student writing.

Writing Feedback Assistant is meant to receive ordinary classroom writing so it can generate academic feedback and run Student Safety Review.

Before submitting real student work, confirm that your school or district permits use of ThinkTorch or external AI services for that purpose. If you are unsure, check with the appropriate administrator, technology representative, or privacy representative. Accepting these Terms does not override school or district policy. If you are not authorized to submit a particular draft, do not submit it.

By submitting material, you represent that you have authority to submit it for that purpose.

Avoid including unnecessary direct student identifiers unless you need them and are authorized to include them.

The optional Student Name or Identifier is for your report labeling. In the current product it is not sent directly to the Academic or Safety models. If you enter a value in that field, ThinkTorch removes exact matches of that value from text sent to ThinkTorch server and model paths before processing. That is not a claim that all identifying information is removed or that submissions are fully de-identified.

ThinkTorch output is AI-assisted support for teacher review. It is not a final decision.

You agree that:

• Your professional judgment is final. Review outputs before you share them, record them, or act on them.
• Suggested skill levels are not automatically grades. They are suggested evidence levels for you to confirm or change against your rubric.
• Student Safety Review draws your attention to potentially concerning language. It is not a diagnosis, a threat assessment, a legal determination, or a mandated-reporting determination. ThinkTorch does not make mandated reports on behalf of teachers or schools. You review the actual student writing, apply professional judgment, and follow applicable school or district procedures and reporting requirements. ThinkTorch does not automatically send Safety flags to parents, schools, law enforcement, child-protection agencies, or other third parties solely because a Safety flag occurs. ThinkTorch may disclose information if required to comply with applicable law or valid legal process.
• Possible Inappropriate AI Use is not proof that a student used AI, cheated, or committed misconduct. It is a prompt for teacher review.
• Assignment requirement checks can be incomplete or unverifiable. The product may mark items as unmet, met, or not verifiable from the submitted text. You still decide what the assignment required and whether the student met it.

ThinkTorch does not make final grading, discipline, authorship, mental-health, or student-safety determinations.

ThinkTorch and its licensors retain the rights they have in the service, including software, design, prompts, documentation, and branding, subject to applicable law. These Terms do not sell you the product. They license you to use the hosted beta as invited.

These Terms do not transfer ownership of student writing. Teachers should not assume they own student work simply because they submitted it for feedback.

To the extent you have rights in or authority over submitted materials, you grant ThinkTorch only the limited rights necessary to process those materials to provide the hosted service, including sending them to infrastructure and model providers as described in the Privacy Policy.

Writing Feedback Assistant uses report allowances. One Generate produces one report, including Safety as part of the same review. Remaining reports, if shown, are operational counts for the beta.

There is no purchase, checkout, or self-serve billing in the current product. Do not assume you can buy more reports in the product today.

We may change allowances for the beta. We may pause paid-model work if an account is not ready or has no remaining reports.

The Privacy Policy explains what we do with teacher information and student work. It is part of how the service operates. If these Terms and the Privacy Policy overlap on data handling, the Privacy Policy is the more specific description of current product behavior.

The service is provided “as is” and “as available” for this beta.

To the fullest extent permitted by law, ThinkTorch disclaims warranties of uninterrupted service, error-free output, fitness for a particular grading or safety purpose, and non-infringement. AI systems can be wrong, incomplete, or uneven.

Nothing in these Terms is meant to exclude liability that applicable law does not allow us to exclude.

To the fullest extent permitted by law, ThinkTorch will not be liable for indirect, incidental, special, consequential, or lost-data damages, or for classroom, grading, or disciplinary decisions you make after using the service.

To the fullest extent permitted by law, ThinkTorch’s aggregate liability arising from the service will not exceed the greater of:

• the amount you paid ThinkTorch for the service during the 12 months before the claim; or
• $100

unless applicable law requires otherwise.

We may change the beta, these Terms, or both. Updated Terms will be posted on this page.

For material changes, ThinkTorch will provide reasonable notice to active beta users where practicable.

If you continue using the service after an update takes effect, later use is governed by the updated Terms. If you do not agree, stop using the service and contact us.

You may stop using the service at any time.

We may suspend or end access at any time for the beta, including if the invitation ends, if you violate these Terms, or if we discontinue the service.

Sections that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) survive termination.

These Terms are governed by the laws of the State of Idaho, excluding conflict-of-law rules.
